Terms of Service

These Terms of Service (“Terms”) govern your use of Novana Index, the free public directory of international schools at index.novana.io (the “Directory”), operated by 不落教育科技株式会社 (Uni Education Technology Co. Ltd) (“we,” “us,” or “our”). By using the Directory, you agree to these Terms. If you do not agree, please do not use the Directory.

These Terms apply to everyone who uses the Directory, including visitors and parents researching schools. If you are a school listed in the Directory, Section 5 explains that you are in complete control of your own listing. How we handle personal information is covered in our Privacy Policy.

1. The service

The Directory is a free, informational website that compiles and presents publicly available information about international schools on a map. It has no user accounts, and it does not sell anything or facilitate enrolment, applications, or transactions with schools.

2. Accuracy, no endorsement, and no reliance for critical decisions

We work to keep the Directory accurate, but we cannot guarantee that every listing is complete, current, or error-free. Information is provided “as is” for general information only. Inclusion of a school is not an endorsement, ranking, certification, or recommendation. Before you make any decision, such as choosing, applying to, or paying a school, you must verify the details directly with the school. You must not use the Directory as a consumer report or to make decisions about any individual’s eligibility.

3. Acceptable use

When using the Directory, you agree that you will not:

• use any robot, spider, scraper, crawler, or other automated means to access, harvest, copy, or extract listings or other content, or otherwise systematically collect or index any part of the Directory in bulk;
• copy, reproduce, resell, republish, or redistribute the Directory or a substantial part of its data;
• attempt to interfere with, overload, or disrupt the Directory or its infrastructure;
• circumvent any technical measures we use to protect or limit access to the Directory; or
• use the Directory for any unlawful purpose or in violation of these Terms or applicable law.

4. Intellectual property

Individual facts about a school are not owned by anyone. However, the Directory as a whole, including its compilation, selection, arrangement, and presentation of data, our software, design, brand, and the “Novana” and “Novana Index” names and logos, are owned by us or our licensors and are protected by intellectual property and database rights. School names, logos, and trademarks belong to the respective schools or their owners, and appear in the Directory for identification and informational purposes only. Nothing in these Terms grants you a right to use our brand, or a substantial part of the Directory’s data, without our permission.

5. Schools control their own listing

We compile listings from publicly available information, and that information may sometimes be incomplete, out of date, or inaccurate. The school itself is always the authoritative source for information about it.

To claim a listing or request a correction or removal, email support@novana.io with a link to the listing and what should change. See the School listings, corrections & removal section of our Privacy Policy for how we handle institutional and personal information.

6. Copyright and content reports

We respect intellectual property rights and expect users to do the same. If you believe that content in the Directory infringes your copyright or other rights, or should be removed, email support@novana.io with enough detail to identify the content (a link), the right you hold, and your contact information, and we will review and act on it promptly.

7. Third-party links

The Directory links to third-party websites, including schools’ own websites. We do not control and are not responsible for the content, accuracy, or practices of those sites, and a link is not an endorsement. Accessing a third-party site is at your own risk and subject to that site’s terms and policies.

8. Disclaimer of warranties

The Directory is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty as to the accuracy or completeness of the Directory’s content or of any site linked from it. Your use of the Directory is at your own risk.

9. Limitation of liability

To the fullest extent permitted by law, we and our officers, employees, and agents will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of, or inability to use, the Directory. Nothing in these Terms limits liability that cannot be limited under applicable law, including under applicable data protection law.

10. Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, arising out of your misuse of the Directory or your breach of these Terms or of applicable law.

11. Changes to the Directory and these Terms

We may change, suspend, or discontinue any part of the Directory at any time. We may also update these Terms from time to time; when we do, we will revise the “Last updated” date above, and your continued use of the Directory means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of Japan, and you and 不落教育科技株式会社 agree that the courts of Japan have exclusive jurisdiction over any dispute arising in connection with these Terms, without regard to conflict-of-law principles.
